Photography Agreement
1. Scope of Work
Photographer will provide professional HDR photography and/or videography services, including: aerial drone photos; ground-level exterior photos; interior photos; and edited deliverables as outlined in the selected package.
2. Delivery Timeline
Final edited photos and/or video will typically be delivered digitally within 24 hours after the shoot. This timeframe is an estimate and may be reasonably extended in the event of technical or scheduling issues, in which case Photographer will notify Client and provide an updated delivery time.
3. Usage Rights
Client is granted a non-exclusive, non-transferable license to use the photos and/or video for marketing and promotion of the specific property photographed, including but not limited to MLS, real estate websites, social media, print flyers, and email campaigns related to that listing. All copyright remains with Sky High Gallery.
4. Rescheduling & Cancellations
If weather prevents aerial work, the session will be rescheduled at no extra charge. Cancellations within 24 hours of the scheduled shoot may result in forfeiture of the booking fee.
5. Liability
Photographer is not responsible for the condition, staging, or preparation of the property. Client is responsible for ensuring the property is photo-ready at the time of the shoot.
6. Refunds, Cancellations & Satisfaction Policy
Due to the custom and time-based nature of photography and videography services, all fees are non-refundable once the session has taken place. Services include scheduling, travel, professional expertise, on-site shooting, and post-production work, all of which are considered fully rendered regardless of the Client’s personal preference or subjective opinion of the final images or video.
Photography and videography are creative services. Refunds will not be issued for dissatisfaction related to style, composition, lighting, color grading, editing choices, or creative direction, provided the services have been delivered as described at the time of booking.
If the Client has concerns with specific deliverables, the Photographer may, at their sole discretion, offer reasonable revisions or re-edits. Requests must be submitted within a reasonable timeframe after preview delivery.
Preview files may be provided prior to final delivery. Full-resolution downloads and usage rights are released only after final payment is received, ensuring the Client has an opportunity to review and request minor adjustments before completion.
Cancellations made prior to the scheduled session may be eligible for rescheduling at the Photographer’s discretion. Any booking, retainer, or reservation fees are non-refundable unless otherwise stated in writing.
